1. COMPANY INFORMATION

Hey Folks LLC (hereinafter referred to as “Hey Folks”), a Swiss company registered with the Commercial Register under UID CHE-386.334.956 and headquartered in Lausanne, Switzerland, provides educational, creative, outdoor and recreational activities for children.

2. SCOPE OF APPLICATION

These Terms and Conditions govern all services provided by Hey Folks, including day camps, holiday camps, special events, adventure days, birthday experiences and any related services.

By registering for any activity, parents or legal guardians acknowledge that they have read, understood and accepted these Terms and Conditions in full.

3. REGISTRATION AND AGREEMENT

A binding agreement is formed once:

  • the registration has been submitted by the parent or legal guardian;
  • these Terms and Conditions have been accepted;
  • the registration has been confirmed by Hey Folks.

Parents are responsible for ensuring that all information provided is accurate, complete and up to date, including any medical conditions, allergies, treatments or specific support needs.

Hey Folks reserves the right to refuse any registration at its sole discretion.

4. PARENTAL RESPONSIBILITIES

Parents and legal guardians agree to:

  • provide all information necessary for the safe supervision of their child;
  • remain reachable throughout the duration of the activity;
  • collect their child at the agreed times;
  • promptly inform Hey Folks of any change in circumstances.

Any omission, inaccurate information or failure to disclose relevant details remains the sole responsibility of the parent or legal guardian.

5. PROGRAMME CHANGES

Hey Folks will make every reasonable effort to deliver activities as advertised.

However, Hey Folks reserves the right to modify:

  • the programme;
  • locations;
  • activities.

Such changes may be required due to safety considerations, weather conditions, logistical constraints or the best interests of the group.

These modifications do not entitle participants to a refund.

6. SUPERVISION AND LIABILITY

Hey Folks is responsible for supervising children only during the published activity hours.

Outside these hours, responsibility rests entirely with the parents or legal guardians.

To the fullest extent permitted by law, Hey Folks’ liability is limited.

In particular, Hey Folks shall not be liable for:

  • loss, theft or damage to personal belongings;
  • damage caused by a participant;
  • circumstances beyond its reasonable control.

7. TRANSPORTATION AND TRAVEL

Parents expressly authorize their child to participate in any travel associated with activities, including transportation by company vehicles, public transport or travel on foot.

Hey Folks undertakes to comply with all applicable safety requirements.

8. HEALTH AND MEDICAL EMERGENCIES

In the event of a medical emergency, Hey Folks is authorized to take any action considered necessary, including:

  • contacting emergency services;
  • arranging medical treatment or hospitalization.

Any medical expenses incurred remain the responsibility of the parents or legal guardians.

Parents confirm that their child is physically and medically fit to participate in the activities.

9. INSURANCE

Each participant must be covered by valid health and accident insurance.

Hey Folks accepts no responsibility for insufficient or absent insurance coverage.

10. BEHAVIOUR AND EXCLUSION

Any behaviour that compromises the safety, wellbeing or enjoyment of participants, staff or activities may result in immediate exclusion.

No refund will be granted in the event of exclusion.

11. PHOTOGRAPHY AND IMAGE USE

Two distinct categories apply:

a) Internal Use (WhatsApp Groups and Parent Communications)

Photos and videos may be shared privately with participating families, including images where children may be recognizable, solely for activity updates and family memories.

b) External Communications

Hey Folks is committed to protecting children’s privacy and does not publish images that directly identify a child. Images used for communication purposes are limited to non-identifiable content such as silhouettes, details or photographs where faces are not visible.

Any external use remains subject to prior authorization.

Parents agree not to redistribute content shared within private groups, including WhatsApp groups, outside that context without the consent of the other families concerned.

12. CANCELLATION BY PARENTS

All cancellations must be submitted in writing.

Unless otherwise agreed:

  • refunds are not guaranteed;
  • a credit note may be offered at the discretion of Hey Folks;
  • administrative fees may be retained.

13. CANCELLATION BY HEY FOLKS

Hey Folks reserves the right to cancel an activity due to:

  • insufficient registrations;
  • force majeure;
  • safety concerns.

In such cases, participants may be offered an alternative date or a credit note.

14. FORCE MAJEURE

Hey Folks shall not be held liable for events beyond its reasonable control, including but not limited to:

  • extreme weather conditions;
  • natural disasters;
  • pandemics;
  • government or authority decisions;
  • any unforeseeable event preventing the normal delivery of services.

15. PAYMENT TERMS

Payments must be made according to the instructions provided during registration.

Unless otherwise stated:

  • a deposit may be required to secure a reservation;
  • the balance must be paid before the activity begins.

In the event of late or non-payment:

  • Hey Folks may cancel the reservation;
  • administrative charges may apply.

Late payments may also incur:

  • reminder fees;
  • statutory interest as permitted under Swiss law.

Any reserved place remains payable unless otherwise agreed in writing by Hey Folks.

16. LATE PICK-UP

Parents agree to respect all drop-off and collection times.

In the event of late collection:

  • an additional fee may be charged;
  • a fixed late collection charge may apply depending on the duration of the delay.

Repeated or significant delays may result in future registrations being refused.

17. TRANSPORTATION – ADDITIONAL LIABILITY PROVISIONS

Parents expressly authorize Hey Folks to transport their child as part of programme activities.

Transportation may take place:

  • in company vehicles;
  • on public transportation;
  • on foot.

Hey Folks undertakes to:

  • comply with all applicable safety regulations;
  • provide appropriate child restraints and supervision where required.

Parents acknowledge that:

  • transportation involves inherent risks;
  • Hey Folks cannot be held liable for unforeseen events beyond its reasonable control.

18. WEATHER CONDITIONS

Activities take place in a variety of weather conditions.

To ensure the safety and comfort of participants, Hey Folks reserves the right to modify:

  • locations;
  • activities;
  • organisational arrangements.

Such adjustments do not entitle participants to a refund.

19. REFUSAL OF PARTICIPATION

Hey Folks reserves the right to refuse or discontinue a child’s participation where:

  • behaviour is incompatible with group activities;
  • specific needs have not been disclosed or cannot reasonably be accommodated;
  • the child presents a risk to themselves or others.

In such circumstances:

  • refunds are not guaranteed;
  • parents must collect their child as soon as reasonably possible.

20. DATA PROTECTION

Personal information is processed in accordance with the Swiss Federal Act on Data Protection (FADP).

Information is used solely for the management of activities and customer relations.

21. SEVERABILITY

Should any provision of these Terms and Conditions be deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by Swiss law.

Any dispute shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
